This Privacy Policy (this "Policy") is effective as of September 18, 2024. This Policy applies to websites, apps,
and other services we operate under the Banded brand (the "Platform"). If you do not agree to this Policy, you may
not use the Platform, which is developed and maintained by Banded LLC. Your prior activities on the Platform may
have been controlled by an earlier version of this Policy.
The purpose of the Platform is to allow users in the United States to create profiles and exchange information
with others, including through the use of NFC-based jewelry and devices. This Policy describes how we collect and
handle information learned about you through your use of the Platform. If you have questions or wish to contact us
about this Policy, you may direct inquiries to:
1. General
- 1.1. From time to time, we may use your information in new ways. If the Platform's information practices
change materially at some time in the future, we will revise and post this Policy accordingly. In addition, if
we have collected personally-identifying information from you, we will notify you about the changes and get your
consent before making use of your information in new ways.
- 1.2. We also rely on third-party platforms for receiving and processing certain information, such as payment
information, analytics, integration with other software, and APIs. Please refer to the policies of those
third-party platforms for more information on their data collection and use practices.
2. What Information Do We Collect?
- 2.1. The information we collect varies depending upon your activities when using the Platform. We collect
personally-identifying information you choose to provide to us, including when you contact us, when you create
an account, or when you create a profile. This information may include your name, email address, date of birth,
photograph, physical characteristics, personal interests, occupation, location, information about other social
networking services you use, and any other information you provide to us. We may also receive information
contained in the contents of any public or private messages you send through the Platform, as well as the
contents of any public or private comments or information you post through the Platform.
- 2.2. We may also automatically collect certain information to while you are using the Platform, including
actions you take when using the Platform. This can also include hardware and software information, including
operating system, browser type, and similar information, as well as your current geographic location.
- 2.3. We ask for your consent to access your geographic location. If you allow such access, we collect your
geographic location to determine your distance from other users. You can turn off or modify access to your
geographic location via the settings on your device or the Platform.
3. How Do We Use This Information?
- 3.1. When you contact us and provide your contact information, such as an email address, we may use that
information to answer any questions you ask through the Platform or to contact you regarding your communication
sent through the Platform. We may also use the information we collect to provide you access to, and use of, the
Platform, allow your account to function, to send you emails, notifications, or additional information about the
Platform or its contents, to allow you to contact others through the Platform, to analyze trends, to administer
the Platform, to track your use of the Platform, for legal and safety reasons, including to defend or protect
us, you, or others from harm or in legal proceedings, and to gather demographic information about our user base.
We can also use and share your information as you may request, consent to, or upon notice by us, subject to
applicable law.
- 3.2. We will share your personal information with trusted third parties who assist us in operating the
Platform, such as credit card processers, so long as these parties agree to keep the information confidential.
To the extent that the Platform sends or receives communications with other platforms, applications, or
services, your personal information may be shared with them. Their use of your information may be subject to
their own privacy policies and terms of service. We may also release your personal information when we believe
release is appropriate to comply with the law, enforce our policies, or protect our safety, property, or rights,
or the safety, property, or rights of others. We may also share user information, in the aggregate or
individual, with third parties for purposes of analysis and monetization, including through ad networks.
Otherwise, we do not rent, sell, or transfer personal information to any third parties.
- 3.3. We will also share your information as part of your use of the Platform, such as sharing your profile
information and geographic location with other users. DO NOT INCLUDE INFORMATION IN YOUR PROFILE OR OTHERWISE
PROVIDE INFORMATION WHEN USING THE PLATFORM THAT YOU WANTO KEEP PRIVATE. Users can also use the Platform to
search for others by information you provide to us.
- 3.4. In the future, this App could be sold or transferred. If that happens, the information we have gathered
may be one of the assets transferred.
4. How Long Do We Keep Your Information?
- 4.1. The Platform will retain all information and content indefinitely until deleted by you. We will retain
your account information indefinitely until you delete your account. We reserve the right to delete information
when it is no longer needed for any of the uses discussed in this Policy.
5. Information Access
- 5.1. If you would like to find out what information we have about you, or if you would like to correct or
update any information, you may contact us using the information above. We can ask you for information to verify
your identity before we disclose or correct any information. If we ask for verification, the information you
provide to verify your identity will be used only for that purpose, and this information will be destroyed when
the process is complete.
6. Security
- 6.1. The security of your personal information is important to us. We follow industry standards to protect the
personal information we collect and save and to protect content sent through or stored in the Platform. Remember
that nothing is 100% secure. While we use standard methods to protect your personal information, we cannot
guarantee its absolute security. As stated in our Terms of Service, we are not responsible for any harm that may
occur as a result of a security breach.
7. Links To Third Parties
- 7.1. This Agreement applies only to information collected by, or submitted to, the Platform. From time to
time, the Platform or users may link you to linked sites or apps that are not owned by us. We do not control the
collection or use of any information, including personal information, that occurs during your visit to the
linked sites or apps. Further, we make no representations about the privacy policies or practices of the linked
sites or apps, and we are not responsible for their privacy practices.
- 7.2. Be careful of disclosing any of your personally identifiable information when leaving our Platform or
when sharing your information with others. We encourage you to be aware when you leave our Platform and to read
the privacy statements of every site or app that collects personally identifiable information.
8. Children's Privacy
- 8.1. The App is not intended or designed for individuals under the age of 18. We do not collect personally
identifiable information from any person we actually know is a child under the age of 18.
9. CALIFORNIA PRIVACY RIGHTS
- 9.1. Pursuant to California Civil Code Section 1798.83 and the California Consumer Privacy Act of 2018 (the
"CCPA"), users who are California residents can request certain information about the sharing of their own
personal information with third parties for direct marketing purposes during the past year. The information
which you have a right to receive includes the categories of personal information disclosed by us for direct
marketing purposes during the preceding calendar year and the names of the companies that received such
information. You are entitled to receive a copy of this information in a standardized format, and the
information will not be specific to you individually.
- 9.2. You have the right to request that we delete any of your personal information that we collected from you
and retained, in certain circumstances. Once we receive and confirm your request to delete, we will delete from
our records, and direct our service providers to delete from their records, your personal information, in
certain circumstances.
- 9.3. California residents can request this disclosure by sending a verifiable request to us using the contact
information provided above. Please provide sufficient information to allow us to identify you in our records.
You may only make a request to know twice in a twelve-month period. You have the right not to receive
discriminatory treatment by us for the exercise of the privacy rights conferred by the CCPA.
